Themeforest is één van plekken waar veel themedevelopers hun WordPress thema’s verkopen. Als je van plan bent een WordPress thema te kopen via Themeforest, moet je kiezen uit een Regular Licence of Extended Licence zoals je op onderstaande afbeelding ziet. Wat is het verschil tussen deze licenties? Sowieso de prijs! In het geval van X theme is de Regular License $ 63,- en de Extended License $ 3150,-. In mijn geval koop ik bovendien niet alleen een thema voor eigen gebruik, maar ook om bijvoorbeeld klantwebsites mee te maken. Wat mag wel en niet met welke licentie?
Definities van licenties Themeforest
Regular License:
Use, by you or one client, in a single end product which end users are not charged for. The total price includes the item price and a buyer fee.
Extended Licence:
Use, by you or one client, in a single end product which end users can be charged for. The total price includes the item price and a buyer fee.
Of, zoals op de Licences pagina is uitgelegd:
The majority of our items (themes, code, graphics, 3D and flash) are covered by our Standard Licenses. If your end product including the item is going to be free to the end user then a Regular License is what you need. An Extended License is required if the end user must pay to use the end product.
Uitleg licenties Themeforest
Persoonlijk raakte ik nogal in de war van het volgende inzake de Standard Licence:
- Use, by you or one client, in a single end product which end users are not charged for.
- If your end product including the item is going to be free to the end user then a Regular License is what you need.
Mijn klant, die ik als eindgebruiker zie (end user), breng ik toch wel degelijk wat in rekening. Een website lever ik immers niet gratis op.
Met ‘end users’ wordt echter wat anders bedoeld gelukkig. Ik zal het toelichten nadat ik eerst de definitities heb gegeven van ‘item’ en ‘end product’.
- Item: hetgeen je koopt via Themeforest, bijvoorbeeld het X thema;
- End product: het eindproduct dat je maakt met o.a. het gekochte item, ingeval van aankoop thema is het eindproduct een complete website.
- End users: de gebruikers van de website, ofwel de websitebezoekers (dus niet mijn klant waar ik de website voor maak!).
Conclusie is dat zolang de website bezoekers gratis de content van de website kunnen bekijken (end users are not charged), een Regular Licence dus geschikt is. Zie onderstaand voorbeeld van Themeforest.

Is het eindproduct echter een website waar de eindgebruikers eerst moeten betalen om de content te kunnen zien, dan heb je een Extended Licence nodig:
Which license do I need for an end product that is only accessible to paying users?
If the end users need to pay to see the end product, you need an Extended License. There can be more than one end user as long as there is only one end product.
Example: A website that requires money before you can access the content
Als slechts een deel van de website tegen betaling bezocht kan worden, voldoet ook een Regular Licence als het thema (item) ook gebruikt wordt voor de gratis toegankelijke content. Als het thema echt alleen gebruikt is voor het deel dat tegen betaling zichtbaar is, dan heb je een Extended Licence nodig. Het volgende voorbeeld van Themeforest gaat niet over websites, maar het principe is hetzelfde.
Example: If you were using a 3d model of a sword for a game and you could only get the sword by buying it, you’d need the Extended License. If it was the starting weapon that even non-paying users could use, all you’d need is the Regular License.
Je moet je echter nog steeds houden aan de regel dat elke licentie slechts geschikt is om één eindproduct mee te maken. Ga ik dus een tweede website (eindproduct) maken voor dezelfde klant, zal ik (namens de klant) opnieuw een licentie moeten kopen. Of dit een Regular of Extended License moet zijn is afhankelijk van de uitleg die ik hierboven reeds heb gegeven:
I’m a freelancer/agency. Can I use the item for an end product I’m doing for a client?
Yes. You’re essentially buying the file on your client’s behalf. Whether a regular or Extended License is needed will depend on your client’s use of the end product. With both the regular and Extended License you are allowed to charge your client for creating the End Product. Once you transfer the end product to the client (eg giving them source files for the item), be sure to link your client to our licenses and delete the item itself from your computer.
Example: If you create a website for a client using a WordPress theme, you could give him the theme as long as you deleted it and linked to our license
Ook is de licentie slechts geldig voor jezelf of voor één klant:
If you are a freelancer / agency using the item for a single end product for one client. The license would in effect be transferred to the client.
